Activity Terms and Conditions
1. Bookings and payment
For activities booked more than 15 days in advance, a deposit of 30% will be required at time of booking, with the balance due 15 days prior to the start of the activity.
For activities booked 15 days or less in advance, and for demos, full payment will be required at the time of booking.
Bookings will only be confirmed once the appropriate payment has been received by us, and you have received written or email confirmation from us.
Should full payment for the activity not be received 15 days prior to the start date, the activity may be cancelled and the deposit forfeit.
2. Cancellation by us
Outdoor activities (especially in Scotland) are reliant on the weather in order to proceed safely. If we have to cancel the activity due to weather or other operational reason, we will offer an alternative date or a full refund. Please note that weather cancellation will be for safety reasons only (usually wind strength) – we won’t cancel just because it’s raining. Every effort will be made to contact you by 6pm the evening before the activity if it is going to be cancelled, but we cannot be held responsible if we are not able to reach you. We are not able to accept liability for any transport, accommodation or other expenses encurred by you in the event of cancellation by us, and strongly recommend you take out adequate insurance. Any refund will be made within 7 working days.
If Covid restrictions mean we are unable to provide the activity we will offer you the option to either reschedule at no cost, or receive a full refund.
3. Cancellation or amendment by you
A booking date can be amended once by you without charge up until 30 days prior to the activity taking place. Additional amendments up until that time will encur a £30 administration fee per person and per amendment. Amendments after that time cannot be guaranteed, and will always encur a £30 administration fee per person and per amendment. This includes bringing a booking date forwards to less than 30 days from the time the amendment is requested.
Any cancellation by you will result in the amount paid being forfeit – ie the deposit up until 30 days prior to the start of the activity, and the full amount after that. This includes cancellations made by you as a result of us being unable to accommodate an amendment to the booking.
4. Safety and risk
4.1 Sea kayaking carries an inherent level of risk. Sea Kayak Oban : Adventures will only be liable for any loss, damage, injury or death caused by our negligence. We strongly recommend you take out insurance covering you for the activity you are undertaking.
4.2 You will be required to complete a risk acceptance form prior to undertaking your activity. This includes medical information. We will do our best to accommodate medical conditions, but if we believe they will affect your safety or anyone else’s, we may refuse to allow you to take part in the activity. A refund will be offered in those circumstances, unless we have reason to believe you deliberately withheld information that you knew could cause concern.
4.3 We will not be liable for any loss, damage, injury or death caused by the negligence of a third party (including another client) while you are on our activity.
4.4 If you fail to follow instructions given by our staff, or if you choose to leave the group, we will no longer be responsible for your safety.
4.5 If we believe you to be intoxicated or your behaviour to be otherwise unsafe, we will refuse to allow you to take part in the activity. No refund will be issued in these circumstances.
